If you are still employed in your fifties, you can often borrow in France without any medical formalities, and sometimes without loan insurance at all. When a home loan is fully repaid before your 60th birthday and the insured share is no more than €200,000 per person, the loi Lemoine forbids the insurer from asking a single question about your health. For consumer credit, borrower insurance is optional in the first place.
A working borrower of 50 to 64 is in a different position from a retiree. Income is higher today but will fall at retirement, and the insurance policy still includes work-related covers, such as temporary incapacity, that normally stop when you stop working. Those two facts are where the savings are found. Many readers arriving from the UK or Ireland are surprised that a French bank expects insurance on a mortgage at all; it is not a legal requirement, but in practice lenders treat it as the default security.
Which rules apply to your age and your loan
Three layers overlap: the loi Lemoine of 2022, now article L113-2-1 of the Insurance Code; the AERAS convention for people with an aggravated health risk; and ordinary freedom of contract for everything else. Your age at the final repayment and the amount insured decide which one protects you.
| Situation | Health questionnaire | Framework |
|---|---|---|
| Home loan repaid before 60, insured share up to €200,000 | Prohibited | Loi Lemoine |
| Home or business loan, insurance ending before 71, up to €420,000 insured | Yes, with AERAS review if the risk is aggravated | AERAS convention |
| Insurance running past the 71st birthday | Yes, outside AERAS | Insurer's own terms |
| Linked consumer loan, borrower aged 50 or under, €17,000 and 4 years maximum | None | AERAS convention |
| Consumer credit beyond those limits | Only if you ask for insurance | Optional insurance |
Using the loi Lemoine between 50 and 59
The scheme is tailor-made for people in their fifties borrowing over a short period. The €200,000 ceiling applies per insured person and across all loans combined. A couple can therefore each insure 100 % of a €200,000 loan without declaring any medical history, provided the last instalment falls before each partner's 60th birthday.
Worked example: a couple aged 53 and 51
Karim, 53, a technician, and Nadia, 51, a care assistant, earn €5,600 net between them. They buy a studio to let with a €120,000 loan over six years at 3.3 %, below the usury ceiling of 4.09 % set for the fourth quarter of 2026 on loans under ten years. The repayment is about €1,840 a month, 33 % of their income and within the 35 % HCSF limit.
The detail that wipes out the advantage
Had Karim chosen seven years, his loan would have ended after his 60th birthday and the questionnaire would have become compulsory again. His heart condition would then have earned him a surcharge. Before fixing the term, calculate the exact date of the last instalment, including any deferred start, against each co-borrower's date of birth.
When the loan runs past 60: lightening the insurance
Once the loan goes beyond 60, insurance does not disappear, but it becomes negotiable. Since the loi Lemoine you can switch home loan insurance at any time, free of charge, as long as the new policy offers equivalent cover. The bank may not raise your interest rate in return, which makes delegation, choosing your own insurer (délégation d'assurance), very worthwhile after 55.
The insured share (quotité) is the other lever. In a couple where one earns €3,000 and the other €1,400, insuring the first at 100 % and the second at 50 % is often enough to protect the survivor while cutting the premium. Most banks simply ask that the shares add up to at least 100 % of the capital borrowed.
Keeping only the covers you will use
Temporary incapacity and occupational invalidity cover protect your salary. They lose their purpose at retirement, and most policies end them at that point. Afi Esca, for example, offers an extension of these covers to age 71 for people who keep working beyond 62 or 64. Conversely, an employee who is about to retire can do without them.
Worked example: Hélène, 57, fifteen-year loan
Hélène, a manager earning €4,200 net, borrows €180,000 over fifteen years. Ending at 72, her loan falls outside AERAS, which requires the insurance to end before the 71st birthday. She therefore picks an outside policy covering death for the full term but incapacity only until 64, and saves on the premium.
Policies designed for the over-50s
Some insurers have built specific products. APRIL's Assurance de Prêt Horizon targets borrowers aged 50 and over, with death cover up to 90. Afi Esca accepts applicants up to 84 and offers a policy with no medical questionnaire, capped at €200,000, to borrowers aged 18 to 58.
Refusals and surcharges: why working seniors get them
For an employee over 50, an insurance refusal is rarely about age alone. It stems from a medical history, a hazardous occupation or an imprecise declaration. Here are the missteps to avoid and how to counter them.
- Signing the bank's group policy without comparing: an outside insurer is often far cheaper for a healthy profile.
- Declaring a cancer cured more than five years ago: under the right to be forgotten (droit à l'oubli) you do not have to mention it.
- Relying on your employer's group protection scheme (prévoyance): it ends with your employment contract and does not replace loan insurance.
- Leaving out a risky sport or a physically demanding job, which can lead to a claim being refused later.
What to do after a refusal
Ask the insurer's medical officer, in writing, for the medical reasons. Then approach other insurers, as each applies its own underwriting grid. If no cover can be found, the bank must consider alternative security: a guarantor, a mortgage on another property or a pledge of savings. Readers holding savings or investments abroad can sometimes offer them, but French banks strongly prefer assets held with a French institution.
The route for a working senior
- Work out your age at the final instalment and the amount insured per person.
- If you are under 60 and €200,000, insist on an offer with no questionnaire.
- Otherwise, request three outside quotes matching the cover in the bank's standard information sheet (fiche standardisée d'information).
- Adjust the insured shares between co-borrowers according to each one's income.
- Hand the chosen policy to the bank, which has ten working days to reply.
The alternatives if insurance stays out of reach
A consumer loan with no insurance is entirely legal and often the simplest answer for amounts of a few thousand euros. For larger needs, a loan secured on a life insurance policy or securities account, or a mortgage-backed loan on a home you already own, lets the asset take the place of the insurance. A co-borrower in good health can also carry most of the insured share.
Frequently asked questions
My employer is offering me a negotiated departure (rupture conventionnelle) at 58: what happens? Incapacity cover will no longer apply since you are not working, but death cover remains. Tell the insurer about the change if your policy requires it.
Does the loi Lemoine apply to a renovation loan? It covers home loans, including renovation loans governed by home loan rules. A renovation loan taken as consumer credit comes with optional insurance.
Can I borrow with no insurance at all at 55? Yes for consumer credit. For a home loan you will need to convince the bank with solid substitute security.
Is switching insurance mid-loan risky? No, provided the new policy is accepted before the old one is cancelled. You are never left uncovered.
