Article 1 – Purpose of the Site

The sole and exclusive purpose of the website creditpoursenior.com, hereinafter “the Site”, is to provide neutral, general, educational and indicative information on credit for seniors and retirees, the lifetime mortgage (prêt viager hypothécaire), deferred-payment sale (vente à terme), debt consolidation, loan insurance (in particular under the AERAS Convention), wealth management, retirement, over-indebtedness and banking inclusion mechanisms for people over 50 in France.

The published content presents, for information purposes, certain provisions of French law, in particular the Consumer Code (Code de la consommation, relating to consumer credit, mortgage credit and loan consolidation), the Monetary and Financial Code (Code monétaire et financier), the Civil Code (Code civil – inheritance law and mortgage guarantees), as well as the tax schemes in force.

The Site is in no way a bank, a credit institution, a financing company, an insurance undertaking, a notary’s office, an intermediary in banking transactions and payment services (IOBSP) or a broker.

Article 2 – No financial authorisation and French regulators

The Site is neither approved, nor authorised, nor supervised by the French financial regulatory authorities:

Consequently, the Site:

  1. Grants no credit (mortgage loan, personal loan, consumer credit, lifetime mortgage, loan buy-back, credit for works or reduced-mobility adaptations);
  2. Receives, negotiates and transmits no loan or insurance offers;
  3. Does not act as a lender, broker, exclusive or non-exclusive agent, banking intermediary, financial investment adviser (CIF), wealth manager or business introducer;
  4. Collects no financing applications and transmits no requests or supporting documents (title deeds, tax notices, pension statements, bank statements) to banks or insurance companies;
  5. Carries out no creditworthiness assessments, no official calculation of repayment capacity, market value of property, remaining disposable income or debt ratio, and takes no decision to accept or reject an application;
  6. Does not consult or query the Banque de France files (in particular the FICP – national register of credit repayment incidents for individuals, or the FCC – central cheque register).

The mention or presentation of a bank, credit organisation, insurance company, mutual insurer, pension fund (e.g. Agirc-Arrco, CNAV), administration or public service on creditpoursenior.com does not mean that the Site has a commercial partnership, mandate, affiliation or business-introducer relationship with that entity.

Article 3 – No personalised advice

The information available on the Site is provided exclusively for educational, comparative and documentary purposes.

It does not in any way constitute:

Any financial, banking, wealth or legal decision taken by a user is their sole and exclusive responsibility.

Before entering into a financial commitment, pledging their real estate assets or consolidating their loans, the user must consult an authorised professional: a bank adviser, a broker registered with ORIAS, a notary, a certified wealth management adviser (CGP) or a Point Conseil Budget (PCB, budget advice centre).

Article 4 – No solicitation and fraud prevention

Article 5 – Banque de France files (FICP / FCC) and health data

The explanatory sheets concerning the Banque de France, the FICP, the FCC, over-indebtedness or the AERAS Convention are provided for information purposes.

The Site is neither affiliated with nor mandated by the Banque de France. It has no access to the national files and can in no case query, modify, regularise or have a payment-incident registration lifted on behalf of a user. All steps relating to the FICP or to the right of access to the files must be taken directly at the counters or on the official website of the Banque de France.

Furthermore, the Site neither collects nor processes any personal health data (medical records, AERAS health questionnaires, health reports).

Article 6 – Limitation of liability

The content published on the Site is prepared with the greatest care by our editorial team on the basis of sources considered reliable at the time of writing. However, the publisher does not guarantee:

To the extent permitted by French law, the publisher declines all liability for any direct or indirect damage (financial, moral, material or patrimonial) resulting from the use of the information contained on the Site, from a decision taken on the basis of that information, or from the inability to access the Site.

The Site contains hyperlinks to third-party websites (public services, pension funds, Banque de France, legifrance.gouv.fr). The publisher has no control over these websites and declines all liability for their content or practices.

Article 7 – No institutional affiliation

creditpoursenior.com is an independent information medium.

The Site is neither an official service of the French State nor a body dependent on the Ministry of Solidarity and Autonomy, the pension funds (CNAV, Agirc-Arrco), the Banque de France, the ACPR or the AMF. The names, acronyms or trademarks cited are used exclusively for educational illustration.
