A loan with a guarantor is credit whose repayment is backed by a third party who undertakes to pay if the borrower does not. In France that third party can be an individual, typically a relative standing as surety (caution), or a guarantee company such as Crédit Logement, which backs roughly one home loan in three in France instead of a mortgage charge.
Between 50 and 64, the question arises from both sides. You may need a guarantor because your age, a temporary contract or falling income worries the bank. Or you may be asked to guarantee a son's or daughter's loan, a heavy commitment that has to remain compatible with your own retirement. This page covers both situations, with notes for English-speaking families where the guarantor or the borrower lives outside France.
The two main kinds of guarantor
A personal guarantee from an individual costs nothing but puts their own income and assets on the line. A guarantee from a specialist company costs a fee but involves no relative. According to Crédit Logement, more than 60 % of French home loans are secured by a guarantee rather than a mortgage. For consumer loans, banks usually make do with a family guarantee or no security at all.
| Security | Cost | What is at stake | Typical use |
|---|---|---|---|
| Guarantee from a relative | Free | Guarantor's income and assets | Personal loan, student loan, small mortgage |
| Guarantee company (Crédit Logement, CAMCA, SACCEF) | Capped fee per loan plus a mutual fund contribution | No relative; the company pursues the borrower if it pays | Home loans |
| Mortgage charge (hypothèque) | Notary fees and land registration tax | The financed property or another one | Home loans, equity-backed loans |
| Pledge (nantissement) | Modest deed costs | A financial investment | Home loans or Lombard loans |
What a guarantee company charges
At Crédit Logement the fees combine a guarantee commission, capped per loan, and a payment into the Fonds mutuel de garantie (mutual guarantee fund). Everything is paid once, when the funds are first released. When the loan is fully repaid, including early, part of the fund payment is refunded: the latest published rate is 71.07 %, paid about a month after the bank notifies the end of the loan.
The company runs its own review of the file, often within 48 hours. It is a second opinion: if the guarantor company says no, the bank in practice refuses too or demands a mortgage charge instead. Working seniors should therefore take care to present their future situation, especially their pension entitlements, clearly.
Example: a 56-year-old on a fixed-term contract
Laurent, 56, a site manager on an 18-month fixed-term contract (CDD), earns 3,100 euros net. He wants to borrow 15,000 euros over 60 months for building work. His temporary contract worries the bank. His sister, a civil servant earning 2,800 euros with no loans, agrees to act as joint and several guarantor (caution solidaire). At 6 %, the payment comes to about 290 euros, 9 % of his salary, and the bank says yes.
The rate stays below the 8.56 % usury ceiling for credit above 6,000 euros in the fourth quarter of 2026. Without a guarantor Laurent could have tried microcredit, but its 8,000-euro ceiling would have covered only part of the job.
Protections for guarantors since 2022
The reform of French security law, introduced by an ordinance of 15 September 2021 and in force since 1 January 2022, rewrote the rules. An individual guarantor must personally write the amount of the commitment in figures and words (article 2297 of the Civil Code). If the commitment was manifestly disproportionate to their assets and income, it is reduced to the amount they could have guaranteed (article 2300).
A professional lender must also tell the guarantor each year how much is still owed (article 2302) and warn them of the first payment incident. If it fails to, it loses the right to claim certain penalties and interest. These protections apply to guarantees signed since 2022. A guarantor who does not read French should have the deed translated before signing; writing the amount by hand in French does not mean understanding the rest.
Standing guarantor after 55: the risks
Guaranteeing a child's loan feels natural, but the commitment sometimes runs past your retirement. If the child stops paying in 2034, your pension will be what repays the bank. With a joint and several guarantee, the lender can come straight to you without first pursuing the borrower.
- No clear limit: always insist on a stated ceiling and a duration.
- Several guarantees at once: backing two children can exceed what you can truly afford and block your own plans.
- Impact on your own borrowing: your bank may take the guarantee into account if you apply for a loan.
- Inheritance: the guarantee passes to your heirs for debts that arose before your death.
Why a bank may reject an older guarantor
A 63-year-old guarantor close to retirement is assessed on their future pension. If it would not cover the repayments in the event of default, the bank will judge the guarantee insufficient or even disproportionate. It may ask for a second guarantor, a mortgage charge or a pledge. Offering a simple guarantee (caution simple) limited to part of the loan is often better received than an open-ended one. A guarantor who lives in the UK or the US is accepted by some lenders, but enforcing a guarantee abroad is harder, so expect extra questions or a request for assets located in France.
How to arrange a loan with a guarantor
- Choose the security that fits the loan: relative, guarantee company, mortgage charge or pledge.
- Check that the intended guarantor has stable income and little debt.
- Gather documents: identity, tax notice, payslips or pension statements, assets.
- Set out in writing the amount, duration and type of commitment, simple or joint and several.
- Have the guarantee deed reviewed by a notaire or lawyer if the sum is large.
- Keep the lender's annual information letters for the whole life of the loan.
How much can you guarantee safely?
A prudent rule is never to guarantee more than you could repay yourself while keeping your total debt ratio within 35 %, future pension included. For a 60-year-old parent who will receive a pension of 2,200 euros and has no loans left, that means a guaranteed payment of about 770 euros a month at most.
Alternatives to a family guarantor
For a home loan, a guarantee company avoids involving a relative and often costs less than a mortgage charge. For a business project, France Active can guarantee up to 80 % of a bank loan, and the Adie accepts a relative guaranteeing only half of a microloan. A co-borrower, finally, brings income as well as a signature.
If no security is available, borrowing less, extending the term slightly or pledging an assurance-vie is safer than relying on a fragile guarantor.
Guarantor questions answered
Can a retiree be a guarantor? Yes. A pension is stable income, but the bank will check that it is sufficient and that the commitment is not disproportionate.
Can a guarantor withdraw? Once signed, a guarantee cannot be cancelled unilaterally for existing debts. An open-ended guarantee can be terminated for the future.
Are Crédit Logement fees refunded? Only the part paid into the mutual guarantee fund, at the refund rate then in force, once the loan has been repaid without incident.
Is a disproportionate guarantee void? Since 2022 it is no longer cancelled but reduced to the amount the guarantor could reasonably have met when signing.
